Privacy Policy

Chesterfield Laboratories Inc. doing business as Critical Moments (“Critical Moments”, “we”/”us”) is committed to protecting your privacy. We make the website criticalmoments.io (the “Website”) available together with the Critical Moments software and other custom features of our services (the “Services”).

Personal Information: This Privacy Policy describes how we collect, store, use and disclose information about identifiable individuals and information which can be used to identify an individual (“Personal Information”). Personal Information may be collected about our users, as well as visitors to the Website.

Consent. By using the Services, you consent to the use of your Personal Information as described in this Privacy Policy. You may withdraw your consent to our processing of your Personal Information at any time but withdrawing consent will result in your inability to continue using key features of the Services.

Information We Collect. When you open an account with Critical Moments, we collect the following types of Personal Information:

  • Name
  • Business Name
  • Email address
  • Credit card
  • App information (app name, website, app store URL, bundle ID); and
  • Billing address (for credit card verification)

Moreover, when you use the Services, We collect the configuration files you upload, including metadata such as time, which may contain Personal Information. We also track Services usage in order to customize your user experience and allow us to monitor the Services generally for improvement.

We will maintain the confidentiality of any contact information you provide to us on signing up for our Services or contacting us with questions or for further information and we will use it only for the purposes for which we have collected it.

Cookies and Usage Data. We may also collect your IP address and information from your browser through the use of cookies. You can set your browser to notify you when you are sent a cookie. This gives you the chance to decide whether or not to accept it. If you disable cookies, you may not be able to take advantage of all the features of the Services. We do not link any of the information we use in cookies to any personally identifiable information submitted by you. We also track and collect non-personal, aggregated anonymized information either directly or through third-party services like Cloudflare Web Analytics. We use this information to better provide, administer, analyze and improve our Services. Sometimes we will provide a Services id or email address to third-party service providers like Cloudflare Web Analytics to help in debugging the operation of such third-party services with the Services.

Geo-IP-Service. Critical Moments provides a Geo-IP-Service for resolving approximate geo-location from an IP address. You have control over if the Geo-IP-Service is used. The Geo-IP-Service is not called by the Service unless you configure an instance of the Service to use it. If you do not wish to send geo-location data to us, please do not configure the Service to use the Geo-IP-Service. Critical Moments does not collect location data, but may collect IP addresses using the Geo-IP-Service. By using the Geo-IP-Service (including configuring an instance of the Service to use it), you consent to this collection, and you consent to collecting appropriate consent from any end-users to whom your distribute the Service.

Information Uses. We collect Personal Information mainly for the following purposes:

  • To contact and correspond with you;
  • To facilitate, enable and enhance use of the Services, including generating API keys, and enabling you to upload and sign configuration files;
  • To understand your needs and develop and recommend suitable products and services;
  • To process payment transactions;
  • To resolve disputes, collect fees and troubleshoot problems;
  • To prevent potentially prohibited or illegal activities and enforce our policies; and
  • To meet legal and regulatory requirements.
  • To analyze user content in aggregate in order to create anonymized and aggregated statistics that may include trends, insights, heuristics and other aggregated learning.

Third-Party Advertisements. Advertisements appearing on the Website may be delivered by us or one or more third-party web advertisers. These third-party web advertisers may set cookies. These cookies allow the advertisement server operated by that third party to recognize your computer each time they send you an online advertisement. Accordingly, advertisement servers may compile information about where or whether you viewed their advertisements and which advertisements you clicked on. This information allows web advertisers to deliver targeted advertisements that they believe will be of most interest to you. The Privacy Policy applies to cookies placed on your computer by us but does not cover the use of cookies by any third-party web advertisers. For the privacy practices of such third-party web advertisers, you should consult the applicable privacy policy for the relevant third-party web advertiser(s).

Your Personal Information will not be used for any purpose other than those above mentioned without your consent however see Important Exceptions below.

Important Exceptions: We may disclose your Personal Information to third parties without your consent if we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with our rights or property, other users of the Services, or anyone else that could be harmed by such activities. We may disclose Personal Information when we believe in good faith that such disclosure is required by and in accordance with the law.

Processing and Transfers: We have put in place contractual and other organizational safeguards with our agents to provide a reasonable level of protection for your Personal Information (see further Security below). In addition to those measures, We will not disclose or transfer your Personal Information to third parties without your permission, except as specified in this Privacy Policy.

From time to time We may employ third parties to help Us improve or otherwise make available features on the Website and Services, whether through the provision of maintenance services, database management, Web analytics or otherwise. We may provide Personal Information collected from you, to service providers as necessary to enable the service provider to perform its obligations to us. In particular, Critical Moments uses the third-party service providers as sub-processors of Personal Information listed on our “Sub-processors” webpage. They will be subject to contractual restrictions prohibiting them from using or disclosing any Personal Information for any other purpose. Where possible, we utilize pseudo-anonymization to limit the Personal Information being transferred to third parties.

Our servers are located in the United States (although this location may change from time to time) and accordingly your Personal Information may be available to the U.S. government or its agencies under a lawful order, irrespective of the safeguards We have put in place for the protection of your Personal Information. By using our Website and Services, you consent to the hosting of your Personal Information in the United States. We reserve the right to store and process Personal Information in other jurisdictions and will use commercially reasonable efforts to provide you with at least 30 days' notice of any such changes in the processing location.

Security: The security of your Personal Information is important to us. We use commercially reasonable efforts to store and maintain your Personal Information in a secure environment. We take technical, contractual, administrative, and physical security steps designed to protect Personal Information that you provide to us. You are also responsible for helping to protect the security of your Personal Information. For instance, never give out your email account information or password for the Services to third parties.

Retention: We will keep your Personal Information for as long as it remains necessary for the identified purpose or as required by law, which may extend beyond the termination of our relationship with you. All retained Personal Information will remain subject to the terms of this Privacy Policy. If you request that your name be removed from our databases, it may not be possible to completely delete all your Personal Information due to technological and legal constraints.

Additional Privacy Protections for Children: We recognize that children, including young teens, may not be able to make informed choices about Personal Information requested online. Accordingly, we do not target children or teenagers for collection of information online.

Amendment of this Policy: We reserve the right to change this Privacy Policy at any time. If we decide to change this Privacy Policy in the future, we will post a notice on the Website. Any non-material change (such as clarifications) to this Privacy Policy will become effective on the date the change is posted and any material changes will become effective ten (10) days from their posting on the Website. Unless stated otherwise, our then - current Privacy Policy applies to all Personal Information that we have about you. The date on which the latest update was made is indicated at the bottom of this document. Your continued use of the Services signifies your acceptance of any changes.

Access and Accuracy: You have the right to access the Personal Information we hold about you in order to verify the Personal Information we have collected in respect to you and to have a general account of our uses of that information. Upon receipt of your written request, we will provide you with a copy of your Personal Information. We will endeavour to deal with all requests for access and modifications in a timely manner. We will make every reasonable effort to keep your Personal Information accurate and up-to-date, and we will provide you with mechanisms to update, correct, delete or add to your Personal Information as appropriate. As appropriate, this amended Personal Information will be transmitted to those parties to which we are permitted to disclose your information.

Residents of The European Economic Area (“EEA”): Critical Moments generally processes Personal Information in order to fulfill contracts we have with our users and to pursue our legitimate business interests listed above. Otherwise, Critical Moments will obtain express consent from an individual in respect of processing of Personal Information if required by law to do so.

Further, individuals located in the EEA have certain rights under European law (including under the General Data Protection Regulation) with respect to Personal Information, including the right to request access to, obtain, correct, amend, delete, or limit the use of your personal data. Individuals located in to the EEA who wish to exercise these rights, should contact Critical Moments using the contact information below. Individuals also have the right to make complaints to regulatory authorities in respect of our privacy practices.
